Lawyer Joshua Brownlee caught the insurance company hiding a vital document that it refused to produce until days before explaining to a judge why it did so. he was “privileged”. The document was called the JMI Report on the Register of Carriers’ Privileges and dated almost two years before the date of the loss. The document was declared “privileged” under the work product doctrine, which protects only documents prepared in anticipation of litigation. It is understood that the document, which preceded the loss of the item for almost two years, was not prepared pending the court case and Mr. Brownlee was forced to file a motion to compel the JMI report asking the court to compel its production. Four months later, and just days before the hearing on the motion to compel production of the JMI report, the purported privilege was waived and the report was produced. Not surprisingly, the JMI report is obtained from the conveyancer to document the condition of the roof, proving that our client’s roof was in good condition at the time of the roof insurance.
The insurance company defended its coverage decision by saying the roof was simply old. However, despite having conducted their own inspection of the property less than two years prior to the date of loss and finding that the roof was in an insurable condition, they are now denying the pre-existing damage claim.
